Atheros cannot talk at 10bT/HalfDuplex

I'm actually a FON (Atheros platform) user/refugee. There is a known problem with the FON router (model 2100A/B/C) if it's connected to a 10bT/HalfDuplex port.
While running the FON firmware it caused my FON router to reboot if it had traffic - maybe once per 3-30 minutes of usage (variable).
With OpenWRT on it I noticed that the throughput of SCP copies to it would show transfer rates that would rise and fall like a roller-coaster (e.g. as low as zero Bps for a few seconds at a time).

I presume that a fix to the driver (ar2313.c? phy.c?) can solve this.
This problem shows up in Kamikaze7.09 as well as the most recent trunk build (/presumed/ for the trunk build since logread says that full duplex is still effected, even though the FON device is on a 10bT-HalfDuplex hub).
Of note is that some changes have happened to ar2313.c and phy.c between Kamikaze7.09 and trunk build 10223. This seems to have killed ethtool's ability to interact with the eth0 device, since running 'ethtool eth0' says something to the effect that there are 'no settings available'.
So the ostensible bug here (IMO) is that the Atheros platform cannot talk at 10bT/HalfDuplex speed.
