NodogSplash IMQ on .28 or .30 kernel

Using a .28 or .30 kernel on ar71xx or atheros platforms with NodogSplash and OLSR is causing the mesh to be throttled down as well as the clients connectings. This is not the intended function I would think. On a .26 kernel with all the same settings and the same iptables version(atleast on the .28) the behavior is different. The hops between routers with OLSR is not being throttled, on the clients connecting.
I'm thinking this might be more of a difference in the kernel patches for imq then anything else. I'm still rather new here and I'm afraid I might not have enough detail, but I've tested this over and over again and I'm cetain of what is happening. I can do something like ip link imq1 down on a gateway router and it will still do traffic shaping on the clients but it will allow full speed on a one hop away OLSR device if on that device I put down both IMQ modules(of course I lose traffic shaping on that device for clients then).
